On November 23, 1922, the then chairman of the Erzgebirge Association’s trail committee, school director M. Wappler, sent a letter to the Schwarzenberg officials: “Permit me to draw the honored officials’ attention to the preservation of the Emmlerweg. In general, in Schwarzenberg, Raschau, Scheibenberg and other places in the area, the Emmlerweg used to be the traffic route between Schwarzenberg and Scheibenberg and is now an ownerless, but public path. In any case, it is currently one of the most beautiful, dust-free high-altitude trails with great views that should be preserved for walkers and hikers. He disappears near the poison shack because the adjacent field owners are plowing him in with them. The honored officials will be able to easily determine whether this action by the residents is illegal.”

The writer of this submission had no idea at the time that a mountain of files, negotiations, interrogations, research and decisions by two German courts would develop from his lines. That the required statement was not "easy," as Wappler suspected, is illustrated by the fact that it was not made until July 10, 1936 - i. H. 14 years later - the court has finally decided!
